ROOKAKON – TERMS OF SERVICE

1. Overview

These Terms of Service (“Terms”) govern your access to and use of the Rookakon website, store, and related services (“Services”).

The Services are operated by:

By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

Our store is hosted by Shopify.

2. Eligibility & Accounts

You must be at least the age of majority in your jurisdiction, or have permission from a parent or guardian.

You agree to provide accurate and complete information. You are responsible for maintaining the security of your account and all activity under it.

3. Products & Availability

We aim to describe products accurately, however variations (including colour and appearance) may occur.

We reserve the right to:

  • modify or discontinue products

  • limit quantities

  • refuse sales

These actions do not affect confirmed orders unless required by law.

4. Orders & Contract Formation

Placing an order constitutes an offer to purchase.

A binding contract is formed only when:

  • payment is successfully processed; and

  • we issue an order confirmation

We may cancel or refuse orders at our discretion, including for:

  • suspected fraud

  • pricing or listing errors

  • stock unavailability

If payment has been taken, you will receive a refund.

5. Permitted Use

Products are sold for personal, non-commercial use.
Resale or commercial distribution requires prior written approval.

6. Pricing & Payment

All prices are in AUD unless stated otherwise.

We may update pricing at any time prior to order confirmation.

You must provide valid payment details. Failed or declined payments may result in order cancellation.

7. Shipping & Risk

Processing: Typically 2–5 business days
Delivery: Timeframes are estimates only

Risk of Loss:

  • Australia & international: risk transfers upon handover to the carrier

  • United Kingdom: risk transfers upon delivery, in accordance with the Consumer Rights Act 2015

Customs & Duties:
International orders may be subject to import charges, which are your responsibility.

Delays & Loss:
Carrier delays are outside our control. If an order is lost, we will investigate and provide a remedy where appropriate.

8. Returns & Refunds

Our Returns & Refund Policy forms part of these Terms.

Key conditions:

  • 30-day return window

  • Items must be unused, with tags and original packaging

  • Free return shipping for approved returns

  • Refunds issued to original payment method

We reserve the right to reject returns that do not meet eligibility criteria.

9. Cancellations

Orders may be cancelled before processing begins.

Once fulfilment has started, cancellation is not guaranteed.

10. Intellectual Property

All content on the Services (including text, images, branding, and design) is owned by Rookakon or its licensors.

You may not copy, reproduce, or exploit any content without prior written consent.

11. Acceptable Use & Automation

You must not:

  • misuse the Services

  • interfere with security or functionality

  • use automated tools to scrape, extract, or interact with the Services without permission

Authorized assistive technologies are permitted.

12. Third-Party Services

We may provide access to third-party tools or links. These are provided “as is” and we are not responsible for their content or performance.

13. Consumer Rights

Nothing in these Terms limits your rights under applicable law, including:

  • Australian Consumer Law

  • Consumer Rights Act 2015

  • applicable EU consumer protections

Where required, remedies such as repair, replacement, or refund will be provided.

14. Disclaimer

To the extent permitted by law, the Services and products are provided “as is” without warranties of any kind.

15. Limitation of Liability

To the maximum extent permitted by law, Rookakon is not liable for:

  • indirect or consequential losses

  • loss of profit, revenue, or opportunity

This does not apply where liability cannot be excluded under law.

16. Indemnity

You agree to indemnify Rookakon against claims arising from:

  • your breach of these Terms

  • your misuse of the Services

  • your violation of third-party rights

This does not apply to our negligence or unlawful conduct.

17. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You submit to the jurisdiction of its courts, subject to mandatory rights in your country of residence.

18. Changes to Terms

We may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.

20. Mobile Terms of Service

The Rookakon mobile message service (the "Service") is operated by Rookakon (“Rookakon”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Rookakon’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Rookakon through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Rookakon. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Rookakon or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Rookakon mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
